Residential Terms & Conditions

By registering for a Black Earth Compost Curbside Compost Subscription (hereinafter “Subscription”) through our website, you agree to be bound to the following Residential Terms and Conditions. Black Earth Compost reserves the right to change, update, and revise any portion of the Residential Terms and Conditions at any time, at its sole discretion, by posting the most current version of the Residential Terms and Conditions here. If you choose not to accept the changes to the terms, you have the option to terminate your subscription.
Black Earth Compost will provide pickup of compostable waste at your registered location as well as pickup of your additional yard waste (no grass) and textiles with a sticker.
Payments and Subscription
Subscription Renewal:
Your Subscription will automatically renew and your payment method on file will be charged at the start of your renewal period. The subscription term, being the length of service covered in the billing cycle, will remain the same, unless you contact us to change it.
Curbside Collection Account Hold:
If you are going to be away from your residence for four consecutive weeks or more, you can put your account on hold. Please contact us through the residential contact form to arrange a hold ahead of your planned leave.
Cost of Service:
The cost of service is subject to change, and will most likely decrease in price as more people sign up. Through the Black Earth Compost Density Discount program, once a certain threshold of customers, which varies per town, are enrolled or pre-registered, the cost of service will change to a predefined rate set for each city/town. When the threshold is met the new price will automatically be applied to your next subscription renewal. We can not guarantee a time frame for when the price will drop. Black Earth Compost may also increase subscription rates to offset inflation.
Returns, Refunds, and Cancellations
Cancellation:
You may cancel your subscription at any point during your subscription term. To cancel service please contact us through the residential contact form on the website. We reserve the right to cancel your subscription due to a failing payment; contamination; or for other unspecified reasons.
Returns and Refunds:
You may cancel your enrollment within the first 30 days and receive a prorated refund on the subscription. Products ordered through the online shop or during enrollment are non-refundable.
Compostable Waste and Contamination
Compostable Waste:
You agree to only put acceptable compostable material in your curbside bin. Please see this list of acceptable compostable items.
Contamination:
If your bin contains anything that is not acceptable compostable waste we will not take the entire contents of the bin. Contamination includes plastic, styrofoam, metal, etc. Please see this list of unacceptable material.
Privacy and Communication
Privacy:
In certain city/towns we share your information for bin distribution purposes and in some cases with your city/town to report on participation and waste diversion rates. We do not share your information for any other purposes. See our website privacy policy.
Electronic Communication:
When you visit our website or send emails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will use your email address on file to notify you of matters related to your compost collection, such as service delays due to weather, change in pickup day, compost vouchers, etc. We will occasionally send out newsletters and promotional emails. If you would like to be removed from promotional emails you must contact us. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Disclaimer of Liability
Lost, Stolen or Damaged Bin:
Once purchased and received, your compost bin is your responsibility. We are not responsible for lost, stolen, or damaged bins. We encourage you to write a ‘return to’ address on your bin. 13 gallon replacement bins and parts are available for purchase through your customer login. Please email us to arrange purchase and delivery of bins not available in the customer shop.
Missed Pick-up:
If your pick up is missed please notify us as soon as possible through the form in the customer portal. In many cities/towns, but not all, we offer an alternative location where you can drop off your compost. Refunds are not issued for missed pick ups.
Weather or Unforeseen Delay/Cancellation:
In some circumstances it may be necessary to delay your pickup day or cancel it for the week. In the event that weather, mechanical failure, or an unforeseen event may make it unsafe for our drivers and trucks to get to your house we will notify you via email of your change in pickup day.
Miscellaneous
Finished Compost:
As part of your subscription you will receive a voucher in April/May of each year for a cubic foot bag of compost. Subscriptions starting after January 15th will not receive a voucher until the following spring. This voucher is redeemable at participating Garden Centers. You may also elect for Black Earth Compost to donate your portion. You will receive a voucher only if your online account settings are set to receive one. Please make sure your preference is set correctly in your online account. Vouchers can't be traded in for credit. Vouchers expire in October of each year and can not be saved for the next year.
The towns of Ipswich, Manchester-by-the-sea, and Groton have free compost pick up locations and therefore will not receive a voucher.
